Some scholars suggest a reevaluation of how IHL is applied in non-international armed conflicts, proposing a shift towards a human rights regime based on a law-enforcement model rather than an armed conflict model.
Ongoing discussions also revolve around unresolved issues and aspects concerning the application of IHL, such as material, personal, geographical, and temporal scope. There is a current emphasis on examining the intersection of heightened environmental values and legal norms in armed conflict. Additionally, there is a growing acknowledgment of the necessity to reassess the role of humanitarian principles in armed conflict, recognizing that international humanitarian efforts must establish stronger connections with the people affected by such situations.
